Your duty of care
as an employer

In an increasingly globalised economy, business travel abroad is also on the rise, not only for large companies but also for small and medium-sized enterprises. These trips are no longer limited to European countries, but also take people into regions and countries that are risky in terms of security, health and natural disasters.

Many companies are unfortunately insufficiently prepared for the increased requirements with regard to the safety of their employees during business trips and postings. The legislator’s stipulation is clear: the employer has a general duty of care for the safety and health of the employee (§ 618 ff. BGB). If, for example, an employee is injured during a foreign assignment in a country considered to be highrisk, the company is liable. Sufficient information about possible risks before a business trip, including health/medical advice for overseas travel, is therefore imperative in order not to violate the duty of care as an employer.

If an assignment in a crisis region is planned, the employer has a duty of care as well as a duty to inform: companies must not only inform their employees about possible dangers in advance, but also keep them informed during the stay abroad. In this way, companies protect themselves against possible liability claims by their employees in the event of damage or personal injury.
